Gameloft brings 10 HD 3D Games to Android but not to Android Market.
HD, 3D Gaming is here thanks to Gameloft , who announced a bevy of titles being launched on Android but be careful as its not available from the Android Market.
Top quality licenses include titles like Assassin’s Creed and Modern Combat have all been squeezed down onto the mobile screen and have been improved to take advantage of cool features like the touchscreen and Android accelerometer. I have always marvelled at those people who sit there on the tube using their mobile as a make shift steering wheels- however having tried it on my Wii, I can attest it can be quite fun.
I will hopefully be able to test out the games soon, although if they are anything like their video demo at the bottom of the post- they could be on to a winner.
Unfortunately most of the games aren’t available on the Google Android market and need to be purchased direct from the Gameloft site. I personally prefer the comfort blanket of knowing that I can refund the game if I don’t like it within 24 hours, however from their website, I don’t think Gameloft are able to offer the same service. From reading through their “FAQs”, they seem to be offering an Iphone-esque no refunds under any circumstance policy. If you lose your phone or even don’t manage to download the game first time around, you will need to re-purchase the games to play them. If you aren’t able to install it as a result of a technical hitch once downloaded, they will work with you to solve it and may allow a redownload.
All games are paid via Network Operator billing provider “Payforit” which will automatically detect your phone number and with your approval charge your mobile phone bill. On Payforit’s website, they offer compatibility with all the major networks, and look like they offer an easy, viable alternative to paying via your 
Google Checkout. Payforit does not offer any end user customer service, and any refund requests need to be directed through the customer services number of the app you are purchasing.
The games are currently limited to compatibility with HTC Desire, Google Nexus One and Motorola Milestone but with the number of new handsets coming out, I am sure that even more people will be able to take advantage of these games soon. I personally hope that Gameloft will seriously reconsider listing on Android Market, or perhaps relaxing items like their Refund policy to be more user-friendly. The fact that Gameloft is on board with android, is a great sign and hope this is the start of many more games companies to come.

Gameloft has said they will be on their website from Friday this week. Although if you access via your phone , they are there already. I am sure that a company like gameloft would test before release. Can you link to info about the games not running so I can raise it with gameloft?
